Legal Statement

WHEREAS IOWA NARCOTICS OFFICERS’ ASSOCIATION is a non-profit association that provides law enforcement training and education;

WHEREAS Participant desires to participate in the Services offered by IOWA NARCOTICS OFFICERS’ ASSOCIATION.

THEREFORE, the parties agree to the following terms of participation:

This Agreement is effective on the date of signature and continues in perpetuity as between the parties.  Signatures include checkboxes on registration forms either in person or electronically indicating understanding of this document.

 

  1. The parties agree that adequate consideration has been transferred between them to make this Agreement binding

  2. Participant expressly acknowledges that IOWA NARCOTICS OFFICERS’ ASSOCIATION exclusively provides general guidance and instruction regarding specific situations encountered in the course of duty.  IOWA NARCOTICS OFFICERS’ ASSOCIATION does not provide education or oversight for state-specific laws or regulations, nor does IOWA NARCOTICS OFFICERS’ ASSOCIATION provide legal advice for any participant.  The information provided by IOWA NARCOTICS OFFICERS’ ASSOCIATION is the result of occupational experience, only, and is not explicitly endorsed by any local, state, or federal government agency.

  3. All conduct and communication by Participant shall be respectful and civil.  Participant is expressly prohibited from engaging in any recording or videography during any training session.  Participant shall notify IOWA NARCOTICS OFFICERS’ ASSOCIATION, in advance of any Services, of any personal or medical circumstances that might impede the Services to be rendered.  Participant may not post any portion of the training sessions on social media platforms unless granted prior permission by IOWA NARCOTICS OFFICERS’ ASSOCIATION.  If, at the sole and absolute discretion of IOWA NARCOTICS OFFICERS’ ASSOCIATION, Participant violates the agreed terms of conduct, Services shall immediately cease and Participant shall not be entitled to a setoff or refund of any fees.

  4. Participant acknowledges that, by participating in any Services that involve on-site or in-public training, Participant is assuming the risk of all possible damages and injuries resulting from Participant’s actions or omissions.  Participant accordingly agrees that IOWA NARCOTICS OFFICERS’ ASSOCIATION shall not be liable for any damages resulting from Participant’s negligent acts or omissions, and further agrees that IOWA NARCOTICS OFFICERS’ ASSOCIATION is released and held harmless from any resulting claims or damages, unless such claims and damages were directly caused by IOWA NARCOTICS OFFICERS’ ASSOCIATION’s gross negligence or reckless conduct.

  5. Participant may not, directly or indirectly, disclose or use any Confidential Information at any time during or after a training session.  This restriction includes the use of Confidential Information for personal, commercial, or proprietary advantage or profit.  Upon IOWA NARCOTICS OFFICERS’ ASSOCIATION’s request, Participant will return or destroy all copies of the Confidential Information.  Confidential Information means trade secrets, proprietary information, and other information belonging to IOWA NARCOTICS OFFICERS’ ASSOCIATION or any subsidiary or affiliate thereof that are not generally known to the public, and includes any business, presentation, or other training documents that IOWA NARCOTICS OFFICERS’ ASSOCIATION or any affiliate thereof treats as confidential, in any format whatsoever including oral, written, and electronic.

  6. Agreement shall be governed by Iowa law.  Any cause of action arising therefrom shall be resolved in the County of Polk, State of Iowa.  If any term, condition or provision of this Agreement or the application thereof to any circumstances is determined to be invalid or unenforceable to any extent, the remaining provisions of this Agreement shall not be affected and shall remain fully enforceable and valid.

  7. This Agreement sets forth the entire understanding between the parties hereto and supersedes all prior agreements, arrangements and communications, whether oral or written, with respect to the subject matter hereof.  No other agreements, representations, warranties or other matters, whether oral or written, shall be deemed to bind the parties hereto with respect to the subject matter hereof.

  8. Participants may receive a full refund, partial refund or credit of tuition paid for cancellations received in writing at least ten (15) days prior to the first event date. No refunds will be made after this date. Participant substitutions may be made up to five (5) days prior to the first event date. If a registered participant does not cancel and fails to attend the training session, this will be treated as a cancellation and no refund or credit will be issued.

 

  1. Should Iowa Narcotics Officers’ Association postpone an event, the Participant’s registration will automatically roll over to the new date, full refunds, or partial refunds will be completed based on method of payment. Any additional fees due to a change in conference fee, membership dues or regional training fee will be the responsibility of the Participant if they choose to roll over to the new date.  If an event is canceled, a credit will be immediately issued for up to 12 months after the notification of event cancellation, to attend another Iowa Narcotics Officers’ Association program of the registrant’s choice or a refund will be available subject to transaction fees.  If payment is made via check a full refund will be provided.  If payment is made by credit card a refund will be provided minus transaction fees.
